By accessing or using CameraComp, you agree to be bound by these Terms of Service.

1. Agreement to Terms

By creating an account on CameraComp (“the Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you must not use the Platform.

These Terms constitute a legally binding agreement between you (“Member”, “you”) and Bailey Digital Solutions Pty Ltd (ABN 68 689 651 125), trading as CameraComp (“CameraComp”, “we”, “us”).

These Terms apply to your use of the Platform as an individual member, photographer, or judge. If you are accessing the Platform as an administrator of a club or federation, your organisation’s use is separately governed by the CameraComp Club & Federation Platform Agreement (“Platform Agreement”). These Terms still apply to your individual account.

We may update these Terms from time to time. Material changes will be notified by email or in-platform notification at least 30 days before taking effect. Continued use of the Platform after changes take effect constitutes acceptance. If you do not agree to updated Terms, you may close your account.

2. Eligibility

You must be at least 16 years of age to create an account. If you are under 18, you confirm that a parent or legal guardian has consented to your use of the Platform.

You must provide accurate, current, and complete registration information and keep it updated. You may only create one account per person.

3. Your Account

You are responsible for all activity under your account. You agree to:

  • Keep your login credentials confidential and not share them with others
  • Notify us immediately at support@cameracomp.com.au if you suspect unauthorised access
  • Not transfer your account to another person

We may suspend or terminate accounts that violate these Terms, are inactive for more than 24 months, or are used fraudulently. We will provide notice before termination where reasonably practicable, except in cases of fraud or serious breach.

4. What CameraComp Provides

CameraComp is a platform that enables photography clubs, federations, and individual photographers to create, manage, enter, and judge photography competitions. We also provide member galleries, event management, club websites, and related tools.

CameraComp is a facilitator, not an organiser. Competitions are created, managed, and judged by clubs and federations. CameraComp provides the infrastructure but does not control competition rules, judging criteria, judging outcomes, or prize distribution. We are not responsible for decisions made by clubs, federations, or judges.

CameraComp does not endorse any particular competition, club, or federation. Listing on the Platform does not imply endorsement or quality assurance.

5. Your Content

5.1 Ownership

You retain full ownership of all photographs and content you upload to the Platform. CameraComp does not claim any ownership rights over your work.

5.2 Licence Grant

By uploading content, you grant Bailey Digital Solutions Pty Ltd a limited, non-exclusive, royalty-free, worldwide licence to:

  • Display your photographs within competitions, galleries, and results pages on the Platform
  • Create optimised versions (thumbnails, compressed copies) for platform performance
  • Display your work to judges during the judging process
  • Include your work in results announcements and winner displays within the Platform
  • Display your work on club or federation websites hosted on the Platform, where you have entered competitions or are a member

This licence exists solely for operating the Platform and terminates when you delete the content or your account, except where content has been incorporated into published competition results. Published results (including titles, scores, and placement information) may be retained as a historical record even after content deletion. The associated image file will be removed.

5.3 Your Responsibilities

You represent and warrant that:

  • All content you upload is your original work, or you have the necessary rights and permissions to submit it
  • Your content does not infringe the intellectual property rights of any third party
  • Your content does not contain illegal, defamatory, obscene, or objectionable material
  • Any EXIF metadata or GPS data embedded in your photographs is included with your knowledge (you may remove it before uploading)

5.4 Portfolios and Public Content

CameraComp allows you to publish a portfolio showcasing your photographs. When you publish a portfolio:

  • Your portfolio page is publicly accessible to anyone on the internet, including people who are not CameraComp users
  • Your portfolio may be indexed by search engines (such as Google) and may appear in search results
  • Photographs you add to your portfolio are displayed at the resolution you choose — you control which images are included
  • Your display name and any biography you provide will be publicly visible on your portfolio page

You can unpublish your portfolio at any time through your account settings. Unpublishing removes public access immediately. However, search engine caches may take time to update and are outside CameraComp’s control.

CameraComp is not responsible for third-party use of content you have made publicly available through your portfolio. Once content is publicly accessible, third parties may view, link to, or reference it. If you do not wish content to be publicly visible, do not add it to your portfolio.

6. Competition Participation

When entering competitions through the Platform, you agree to:

  • Follow all competition rules set by the organising club or federation
  • Submit only original photographs that you created
  • Accept that judging outcomes are determined by the competition organisers, not CameraComp
  • Not attempt to manipulate results, submit duplicate entries across multiple accounts, or otherwise engage in fraudulent conduct

CameraComp does not guarantee the fairness, accuracy, or quality of judging. Disputes about competition outcomes must be directed to the organising club or federation. CameraComp is not a party to disputes between you and a competition organiser.

7. Payments and Fees

7.1 Payment Processing

All payments on the Platform are processed by Stripe, a third-party payment processor. By making a payment, you also agree to Stripe’s terms of service. CameraComp does not store your credit or debit card details. Card information is entered directly on a Stripe-hosted checkout page.

CameraComp is not responsible for Stripe’s decisions regarding payment declines, holds, or account restrictions. If you experience a payment issue caused by Stripe, you should contact Stripe directly or contact us at support@cameracomp.com.au for assistance.

7.2 Competition Entry Fees

Some competitions require an entry fee set by the organising club or federation. When you pay an entry fee:

  • The entry fee amount is transferred to the club’s or federation’s connected bank account
  • A service fee of 5% of the entry fee is retained by CameraComp as a platform fee
  • A processing fee is charged by Stripe (estimated at 1.75% + $0.30 AUD for Australian cards; actual fees may vary for international cards)

Depending on the club’s settings, these fees may be:

  • Passed through to you (shown as separate line items at checkout), or
  • Absorbed by the club (included in the entry fee price)

The complete fee breakdown, including all applicable fees, will be displayed on the checkout page before you confirm payment. The amount charged to your card will not differ from the amount shown at checkout.

7.3 Membership Dues

Some clubs collect annual membership dues through the Platform. CameraComp does not charge a platform fee on membership dues. Only standard payment processing fees (charged by Stripe) apply.

7.4 Individual Subscriptions

CameraComp offers optional paid subscription tiers for individual members that provide additional storage and features. Subscriptions:

  • Are billed annually and automatically renew unless cancelled before the renewal date
  • Can be cancelled at any time through your account settings; access continues until the end of the current billing period
  • Are refundable within 14 days of purchase if no significant storage has been consumed (more than 10% of the tier’s allocation)

We will send a renewal reminder at least 7 days before your subscription renews. You will not be charged without prior notice.

7.5 Print Sales

If you purchase prints through the Platform, a marketplace commission of 15% is applied by CameraComp. This commission is included in the listed price.

7.6 Refunds

Competition entry fees are generally non-refundable once submitted, as the entry is immediately processed by the organising club. Refunds for competition entries are at the discretion of the organising club or federation. CameraComp will facilitate refunds requested by clubs but is not obligated to issue refunds for competition disputes.

Refunds are processed through Stripe and typically appear within 5–10 business days, depending on your financial institution.

8. Prohibited Conduct

You must not:

  • Upload content that is illegal, obscene, defamatory, or infringes the rights of others
  • Submit photographs that are not your original work without proper authorisation
  • Attempt to manipulate competition results, create multiple accounts, or use automated tools to interact with the Platform
  • Interfere with the Platform’s operation, security, or infrastructure
  • Collect personal information of other users without their consent
  • Use the Platform for any purpose other than its intended use
  • Circumvent payment processing by arranging off-platform payments for Platform-managed activities
  • Harass, abuse, or threaten other users, judges, administrators, or CameraComp staff
  • Attempt to reverse-engineer, decompile, or extract source code from the Platform

Violation of these rules may result in account suspension or termination. Serious or repeated violations may result in immediate termination without notice.

9. Storage and Data

Your account includes a storage allocation determined by your subscription tier. If you exceed your storage limit, you will be unable to upload new content until you upgrade or free up space. Existing content will not be deleted due to exceeding storage limits.

We use industry-standard security measures to protect your data, including encrypted storage, encrypted transmission (TLS), row-level database security, and secure password hashing. However, no system is completely secure, and we cannot guarantee absolute security.

If you delete your account, we will delete your personal data and photographs within 30 days, except where we are required to retain data for legal, tax, or regulatory purposes. Payment and transaction records are retained for 7 years as required by Australian taxation law. Published competition results (titles, scores, placements) may be retained as historical records, but the associated image files will be deleted.

10. Privacy

Our collection and use of your personal information is governed by the CameraComp Privacy Policy, which forms part of these Terms. Key points:

  • We collect only information necessary to operate the Platform
  • Payment card data is processed by Stripe and is not stored on CameraComp servers
  • We do not sell your personal information to third parties
  • EXIF metadata (including GPS coordinates if present) from uploaded photographs is stored but not publicly displayed
  • You can request access to, correction of, or deletion of your personal data at any time

CameraComp may use anonymised image metadata (such as camera model, lens, and exposure settings) and aggregated usage data to improve Platform features, generate industry benchmarks, and create analytical insights. This data will not identify you, your photographs, or your account. This use is described further in the Privacy Policy.

11. Platform Intellectual Property

The CameraComp platform, including its software, design, branding, and documentation, is owned by Bailey Digital Solutions Pty Ltd. These Terms grant you a limited, non-exclusive, non-transferable, revocable licence to use the Platform as a registered member for the duration of your account.

You must not copy, modify, distribute, or create derivative works from any part of the Platform without our prior written consent.

12. Limitation of Liability

12.1 General Limitation

To the maximum extent permitted by Australian law:

  • The Platform is provided "as is" without warranties of any kind, express or implied, except as required by the Australian Consumer Law
  • CameraComp is not liable for any loss arising from competition outcomes, judging decisions, or the conduct of clubs, federations, judges, or other users
  • CameraComp is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or opportunity
  • Our total aggregate liability to you for all claims arising from your use of the Platform is limited to the greater of (a) the amount you paid CameraComp in the 12 months preceding the claim, or (b) $50 AUD

12.2 Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)).

To the extent that CameraComp is entitled to limit its liability under the Australian Consumer Law for a failure to comply with a consumer guarantee, our liability is limited (at our option) to:

  • Resupply of the services; or
  • Payment of the cost of having the services resupplied

13. Indemnity

You agree to indemnify and hold harmless Bailey Digital Solutions Pty Ltd, its directors, officers, and employees from third-party claims, damages, or expenses (including reasonable legal fees) arising from:

  • Your breach of these Terms
  • Content you upload that infringes the intellectual property or other rights of a third party
  • Your use of the Platform in a manner not authorised by these Terms

This indemnity does not apply to the extent that a claim arises from CameraComp’s gross negligence or wilful misconduct.

14. Termination

14.1 By You

You may delete your account at any time through your account settings or by contacting support@cameracomp.com.au. Upon deletion:

  • Your personal data and photographs will be deleted within 30 days
  • Payment records are retained for 7 years (legal requirement)
  • Published competition results may be retained as historical records (without your images)
  • Any active subscription will be cancelled; no pro-rata refund is provided for the remaining billing period

14.2 By CameraComp

We may suspend or terminate your account if:

  • You breach these Terms and fail to remedy the breach within 14 days of notice (where the breach is capable of remedy)
  • You engage in fraudulent, illegal, or seriously harmful activity (immediate termination, no notice required)
  • Your account is inactive for more than 24 months (with 30 days’ notice before deletion)
  • We are required to do so by law or court order

14.3 Effect of Termination

On termination, your right to use the Platform ceases immediately. Sections 5.3 (Your Responsibilities), 12 (Limitation of Liability), 13 (Indemnity), and 15 (Governing Law) survive termination.

15. Governing Law and Disputes

These Terms are governed by the laws of South Australia, Australia. You submit to the non-exclusive jurisdiction of the courts of South Australia for any dispute arising from these Terms.

Before commencing legal proceedings, you agree to attempt to resolve any dispute by contacting us at contact@cameracomp.com.au. We will attempt to resolve disputes within 30 days of receiving notice.

16. General Provisions

16.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and CameraComp regarding your individual use of the Platform. They supersede all prior agreements, representations, and understandings regarding the same subject matter.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force and effect.

16.3 No Waiver

A failure or delay by CameraComp to exercise any right under these Terms does not constitute a waiver of that right.

16.4 Assignment

You may not assign or transfer your rights under these Terms. CameraComp may assign these Terms in connection with a merger, acquisition, or sale of substantially all of its assets, provided the assignee assumes all obligations under these Terms.
